Chicago Gynecologist Accused of Sexually Abusing Over 300 Patients at Several Area Hospitals and Medical Groups

A Chicago gynecologist, Dr. Fabio Ortega, has been accused of sexually abusing more than 300 patients during exams at several area hospitals and medical groups. The accusations against Dr. Ortega were made in a lawsuit filed on March 27, 2024. The lawsuit claims that NorthShore University HealthSystem, now known as Endeavor Health, was aware of Dr. Ortega's conduct but failed to investigate patient complaints.

Dr. Fabio Ortega pleaded guilty to sexually abusing patients during exams in 2021. The lawsuit alleges that he targeted young women who did not have experience with gynecological examinations and that his employers, including NorthShore University HealthSystem and Swedish Covenant Hospital, presented him as a skilled and trustworthy gynecologist while complaints were ignored and sexual abuse was allowed to continue.

Ortega's medical license has been revoked and he can no longer practice medicine. He is currently on mandatory supervised release, or parole, after being released from prison in October 2022.

The lawsuit was filed on behalf of Jane Doe 300 and joins 22 other lawsuits filed against Dr. Ortega and his employers since 2019. Most of the suits allege that the health system knew or should have known that Dr. Ortega was a danger to patients, with four lawsuits alleging that the abuse took place after Endeavor was made aware of a police investigation into Dr. Ortega's conduct.

Swedish Covenant Hospital, which was acquired by Endeavor in 2020, is also named in the lawsuit filed on March 27, 2024.

  • Fallacies (85%)
The article contains several examples of appeal to authority fallacies. The author cites the lawsuit filed on behalf of 'Jane Doe 300' without providing any evidence or context for this claim. Additionally, the author uses quotes from a patient who reported abuse by Dr. Fabio Ortega as an example, but does not provide any information about whether these quotes are accurate or reliable.
    • The lawsuit filed on behalf of 'Jane Doe 300' accuses Endeavor Health of knowingly giving a platform to Dr. Fabio Ortega after being made aware of alleged sexual abuse and predatory behavior.
  • Bias (85%)
The article contains several examples of bias. Firstly, the author uses language that dehumanizes Dr. Fabio Ortega by referring to him as a 'former Chicago gynecologist' who has been accused of sexually abusing more than 300 patients. This implies that he is not trustworthy and his actions are unforgivable, which may sway public opinion against him without providing all the facts. Secondly, the author uses language that demonizes Dr. Ortega by referring to him as a 'predator' who targeted vulnerable women with inappropriate behavior dating back to the 1980s. This implies that he is not only responsible for his actions but also complicit in perpetuating sexual abuse against women, which may be unfair and untrue. Thirdly, the author uses language that suggests Dr. Ortega's employers are covering up his behavior by misleading patients into believing his inappropriate actions were medically necessary. This implies that they are not only responsible for their own actions but also complicit in perpetuating sexual abuse against women, which may be unfair and untrue.

      • Fallacies (80%)
The author of the article alleges that Endeavor Health and former gynecologist Fabio Ortega failed to intervene after other patients complained of sexual misconduct. This is a dichotomous depiction, as it implies that there was only one option for the health system: either they knew or should have known about Ortega's abuse and did nothing, or they concealed his police investigation from their patients. The author does not provide any evidence to support these claims, nor do they acknowledge any possible reasons why Endeavor might have acted as it did. This is a logical fallacy of false dilemma, which presents only two alternatives when there may be more.
        • The lawsuit states Endeavor either knew or should have known about sexual misconduct complaints other patients had raised about Ortega and Endeavor failed to properly investigate, train or discipline the doctor. The plaintiff said in her suit that she did not realize she was abused by Ortega until seeing news articles about him earlier this year.
        • A Tribune investigation earlier this year revealed Endeavor’s pivotal role in keeping Ortega in place for years despite multiple complaints from patients.
      • Bias (80%)
The article contains multiple examples of bias. The author uses language that dehumanizes the victims and portrays them as helpless against a powerful institution. For example, the phrase 'the health system failed to intervene after other patients complained of sexual misconduct' implies that Endeavor was aware of Ortega's behavior but chose not to act on it. The author also uses language that demonizes Endeavor and portrays them as complicit in Ortega's crimes, such as 'they enabled a sexual predator'. Additionally, the article contains examples of religious bias by mentioning that Swedish Covenant Hospital was acquired by Endeavor in 2020. This implies that there is some sort of connection between religion and the abuse committed at this hospital.

              • Deception (80%)
The article is deceptive in several ways. Firstly, the title and body of the article suggest that a lawsuit has been filed against NorthShore University Health System and Swedish Hospital for allowing sexual abuse by OB/GYN Fabio Ortega to occur for decades. However, this is not entirely accurate as it implies that both hospitals are responsible for his actions when in fact they were only aware of some of the allegations made against him. Secondly, the article quotes Parker Stinar and Symone Shinton from law firm Stiner Gould Grieco & Hensley stating that Ortega targeted young women who did not have experience with gynecological examinations, Spanish-speaking patients, pregnant women, Medicare patients and underserved patient population because he knew they were less likely to understand that they were being sexually abused. However this is a misrepresentation of the facts as it implies that Ortega targeted these groups intentionally when in fact his actions may have been unintentional or unconscious. Lastly, the article quotes Shinton stating that despite complaints about Ortega's behavior, NorthShore and Swedish continued to present him to the public as a skilled and trustworthy gynecologist while ignoring allegations of sexual abuse. However this is not entirely accurate as it implies that both hospitals were aware of these allegations when in fact they may have been unaware or did not take them seriously.

              • Fallacies (85%)
The article contains several examples of informal fallacies. The author uses inflammatory rhetoric by describing the actions of Dr. Ortega as 'disturbing' and 'horrific'. They also use an appeal to authority by stating that NorthShore University Health System and Swedish Hospital enabled sexual abuse, without providing any evidence or citation for this claim.
                • The lawsuit said Ortega worked at what was then known as Swedish Covenant Hospital between approximately 1989 and 2007. During that time, he had 'a pattern or practice of disguising his sexual abuses as necessary medical care through a variety of techniques.'
                • He is accused in the lawsuit of sexually abusing girls as young as 14.
                • Some of the sexual abuse detailed in the complaint includes claims that Ortega would visit or call his patients outside of work, wouldn't treat them for conditions presented, falsified records, encouraged unnecessary appointments, conducted unnecessary pelvic exams and asked patients intrusive questions about their sex life.
              • Bias (85%)
The article contains examples of bias in the way it portrays NorthShore University Health System and Swedish Hospital. The language used to describe Ortega's actions is sensationalized and dehumanizing, making him out to be a monster rather than an individual who made mistakes. Additionally, the article implies that these hospitals were complicit in allowing sexual abuse to occur by not taking action against Ortega despite being aware of his behavior. This creates a false sense of moral superiority on behalf of the plaintiffs and their attorneys.
