The International Court of Justice (ICJ) in The Hague is set to deliver a ruling on Tuesday, May 1, 2024, regarding Nicaragua's request for emergency measures against Germany over its military aid to Israel during the ongoing conflict in Gaza. Nicaragua argues that Germany's support enables acts of genocide and breaches international humanitarian law in Palestinian territory.
Nicaragua has a historic connection to the Palestinian people through migration and has accused Germany of failing to honor its obligation to prevent genocide or ensure respect for international humanitarian law. The country seeks an immediate suspension of German military aid, including weapons exports, to Israel.
Germany's legal team argues that Nicaragua's claims lack factual and legal basis. Germany has been a long-standing supporter of Israel due to its history with the Holocaust. However, Berlin has gradually shifted its tone in response to civilian casualties in Gaza and growing criticism of Israel's offensive.
The ICJ previously ordered Israel to prevent death, destruction, and acts of genocide in Gaza back in January 2023. In March 2024, the court issued provisional measures ordering Israel to take steps to improve the humanitarian situation in Gaza amid concerns of an imminent famine.
The International Criminal Court (ICC) is also investigating possible war crimes committed by both Israel and Palestinian militants during the conflict. Israeli officials have expressed concern about potential arrest warrants in that case.
Since the start of Israel's offensive, over 34,500 Palestinians have been killed, mostly women and children. The high civilian death toll is a result of Hamas fighters using residential areas as cover for their attacks on Israeli targets. Israel has killed over 12,000 militants without providing evidence.
The war began when Hamas and other Islamist militants staged an attack on southern Israel, killing some 1,200 people in October 2023. The conflict has displaced about 80% of the population in Gaza and raised concerns about a humanitarian crisis.
Germany is second only to the United States in providing military aid to Israel. The ICJ's ruling on Tuesday will be a preliminary decision, and Nicaragua's case is expected to drag on for years.
