Two men, Johan Jose Rangel Martinez and Franklin Jose Pena Ramos, have been charged with capital murder in the death of 12-year-old Jocelyn Nungaray. Jocelyn's body was found in a creek in Houston. The suspects were seen speaking with Jocelyn at a restaurant and accompanied her to a convenience store and later to the bridge where she was killed. The suspects, who are roommates, have been arrested and are facing capital murder charges. According to police, the medical examiner has determined that Jocelyn's cause of death was strangulation. It is not yet known if Jocelyn knew the men prior to the incident. The results of a sexual assault exam on the victim are still pending. The two suspects, both illegal immigrants, entered the United States through Texas according to U.S. Immigration and Customs Enforcement (ICE). Martinez was apprehended by the U.S. Border Patrol near El Paso, Texas on March 14 and released on an order of recognizance with a notice to appear. Pena was apprehended by the U.S. Border Patrol near El Paso, Texas on May 28 and also released on an order of recognizance with a notice to appear. Sen. Ted Cruz has called for the death penalty for the two suspects if they are convicted of killing Jocelyn Nungaray.
