A United Nations inquiry has found both Israel and Palestinian militant groups, including Hamas, committed war crimes and grave violations of international law during the October 7 attacks and the war in Gaza. The findings come from two parallel investigations conducted by the UN Commission of Inquiry.
On October 7, 2023, Hamas and other Palestinian armed groups launched a series of attacks against Israel, resulting in over 1,200 deaths, mostly civilians. Three Israeli hostages were also murdered by Hamas during this time.
The UN report accuses Israeli forces of responding to the Hamas-led attacks with collective punishment against Palestinians. This response resulted in a crime against humanity and the death of over 37,000 people according to the Ministry of Health in Gaza. The commission also found that both sides were responsible for killing civilians despite their identifying themselves as noncombatants.
The UN report further accuses Israeli forces of acts such as starvation, arbitrary detention, and the killing and maiming of 'tens of thousands of children.' Hamas is accused of committing sexual violence and deliberately killing or abducting civilians. The commission's findings are likely to be used in future criminal proceedings related to the war in Gaza.
The UN Commission of Inquiry was established by the Human Rights Council on March 1, 2024, following a request from Palestine and Israel. The commission conducted interviews with over 350 witnesses and reviewed thousands of documents to reach its findings.
